Privacy Policy

Yapii LLC ("Yapii", "we", "us", or "our") operates the Yapii platform and related services ("Service"). This Privacy Policy describes how we collect, use, and share information when you use our Service, and the choices you have with respect to your information.

1. Information We Collect

1.1 Account and Profile Information

When you register for a Yapii account, we collect your name, email address, phone number, brokerage affiliation, and billing information. We use this information to create and manage your account, process payments, and communicate with you about the Service.

1.2 Contact Database Data

The core function of Yapii is to help you manage and market to your contact database. When you import contacts, you provide us with information about third parties, which may include names, mailing addresses, email addresses, phone numbers, property addresses, and transaction history. You are responsible for ensuring you have the appropriate legal basis to share this information with us.

1.3 Usage and Log Data

We automatically collect information about how you interact with the Service, including pages visited, features used, actions taken, timestamps, IP addresses (stored as a one-way hash), browser type, device identifiers, and referring URLs. This data helps us improve the Service and detect security incidents.

1.4 Communications Data

When you use Yapii to send emails or SMS messages, we retain records of those communications, including delivery status, open events, click events, and unsubscribe requests. This data is necessary to operate the Service and to honor opt-out requests.

1.5 Cookies and Tracking Technologies

We use cookies, local storage, and similar technologies to maintain your session, remember your preferences, and understand how visitors use our marketing site. You can manage cookie preferences through your browser settings. Disabling cookies may limit certain Service functionality.

2. How We Use Information

2.1 Service Delivery

We use the information we collect to provide, maintain, and improve the Yapii platform, including scoring your contacts, generating campaign content, delivering emails and SMS messages on your behalf, and producing market intelligence reports.

2.2 Billing and Payments

We use your billing information to process subscription payments and to send receipts, invoices, and notices of upcoming charges. Payment card data is processed by our payment processor, Stripe, and is not stored on Yapii servers.

2.3 Customer Support and Communications

We use your contact information to respond to support requests, send product update notifications, and deliver transactional messages (such as email verification and password reset links). We may also send you marketing communications about new features or promotions; you can opt out of these at any time.

2.4 Analytics and Product Improvement

We analyze aggregated, de-identified usage data to understand how the Service is used, identify areas for improvement, train and evaluate our AI models, and prioritize new features. We do not use your contact database records to train generalized models that benefit other customers.

2.5 Legal Compliance and Safety

We may use information to comply with applicable laws and regulations, respond to lawful requests from government authorities, enforce our Terms of Service, and protect the rights, property, or safety of Yapii, our customers, or others.

3. Data Sharing

We do not sell your personal information or your contacts' personal information. We share data only in the following limited circumstances:

3.1 Service Providers

We engage third-party vendors to help us deliver the Service, including cloud hosting providers, email delivery services (Mailgun, Resend), SMS carriers (Twilio), payment processors (Stripe), error monitoring services (Sentry), and AI model providers (OpenAI, Anthropic). These vendors process data only on our instructions and are contractually prohibited from using it for their own purposes.

3.2 Business Transfers

If Yapii is acquired, merges with another company, or undergoes a reorganization, your information may be transferred as part of that transaction. We will notify you via email or a prominent notice on the Service before your information is transferred and becomes subject to a different privacy policy.

3.3 Legal Requirements

We may disclose information if we believe disclosure is required by law, court order, or governmental authority, or if we believe in good faith that disclosure is necessary to prevent imminent harm, fraud, or illegal activity.

4. Data Retention

We retain your account information and contact database data for as long as your account is active. If you cancel your subscription, we retain your data for 90 days to allow you to reactivate and to export your records, after which it is deleted from our production systems. Aggregated, de-identified analytics data may be retained indefinitely.

Email and SMS delivery logs are retained for 24 months to support deliverability analysis, bounce management, and opt-out compliance. Audit logs of platform actions are retained for 36 months.

You may request early deletion of your data by contacting us at contact@yapii.com. Some data may be retained for shorter or longer periods when required by applicable law.

5. Your Rights (CCPA / GDPR)

5.1 Rights Under CCPA (California Residents)

If you are a California resident, you have the right to: (a) know what personal information we collect, use, disclose, and sell; (b) request deletion of your personal information; (c) opt out of the sale of personal information (we do not sell personal information); and (d) not be discriminated against for exercising these rights.

To submit a verifiable consumer request, email us at contact@yapii.com with the subject line 'California Privacy Request.' We will respond within 45 days.

5.2 Rights Under GDPR (EEA / UK Residents)

If you are located in the European Economic Area or the United Kingdom, you have the right to access, rectify, erase, restrict, or object to the processing of your personal data, and the right to data portability. Where processing is based on your consent, you have the right to withdraw consent at any time.

Our legal basis for processing is primarily the performance of our contract with you (Article 6(1)(b) GDPR) and our legitimate interests in operating and improving the Service (Article 6(1)(f) GDPR). For marketing emails to prospects, we rely on consent.

To exercise any of these rights, contact our Data Protection contact at contact@yapii.com. You also have the right to lodge a complaint with your local supervisory authority.

5.3 Opt-Out of Marketing Communications

You can unsubscribe from marketing emails by clicking the unsubscribe link in any marketing email. You can opt out of marketing SMS messages by replying STOP to any SMS. Transactional messages (receipts, password resets, etc.) are not affected by marketing opt-outs.

6. Security

We implement industry-standard technical and organizational measures to protect your information, including TLS encryption in transit, AES-256 encryption at rest for sensitive fields, row-level security policies in our database, and access controls that restrict employee access to customer data on a need-to-know basis.

We perform regular security reviews and penetration tests. Despite these measures, no system is completely secure. If you discover a vulnerability, please report it to contact@yapii.com rather than disclosing it publicly.

In the event of a data breach that is likely to result in a risk to your rights and freedoms, we will notify affected users as required by applicable law.
